Terms of Service

By accessing or using Soostori (the "Service") provided by Soostori Retail Systems ("Soostori", "we", "our"), you ("you", "your", "User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users of Soostori, including shop owners, their staff, and any salesperson or partner operating on behalf of Soostori.

Soostori is a cloud-based shop management platform providing point-of-sale (POS), inventory management, debt tracking, staff management, and business reporting tools accessible via web browser, progressive web app (PWA), and desktop application.

The Service is provided "as is" and "as available." We strive for 99.9% uptime but do not guarantee uninterrupted access. Scheduled maintenance windows will be communicated in advance when possible.

To use Soostori, you must create an account through an authorized Soostori Salesperson. You are responsible for:

• Keeping your login credentials confidential and secure.
• All activity that occurs under your account, including by your staff.
• Notifying Soostori immediately of any unauthorized access or security breach.

You must provide accurate and complete information during account creation. Soostori reserves the right to suspend or terminate accounts that provide false information.

You agree to use Soostori only for lawful retail management purposes. Prohibited activities include:

• Using the Service to process illegal transactions or facilitate illegal activity.
• Attempting to gain unauthorized access to Soostori systems or another user's account.
• Using automated scripts, bots, or scrapers without Soostori's written permission.
• Reverse engineering, decompiling, or disassembling any part of the Service.
• Uploading viruses, malware, or any code designed to harm the Service.
• Reselling or redistributing the Service without Soostori's written consent.

Soostori is available on a paid subscription basis. Subscription details:

• Monthly subscriptions are billed in advance on the same date each month.
• Payment is processed via M-Pesa STK Push. You authorize Soostori to initiate payment collection up to the amount due.
• Subscriptions continue automatically until cancelled. You may cancel at any time from Settings.
• If a payment fails, Soostori will attempt to collect again within 3 days. Service may be suspended if payment is not received within 7 days.
• Soostori reserves the right to change subscription pricing with 30 days' advance notice.

You may cancel your subscription at any time through your account settings. Upon cancellation:

• Your access to the Service continues until the end of the current billing period.
• After cancellation, your account data is retained for 30 days before permanent deletion.
• You may export your data at any time before the deletion period.

Soostori may terminate or suspend your account immediately if you violate these Terms or engage in illegal activity.

All content, design, code, trademarks, and intellectual property in Soostori are owned by Soostori Retail Systems. You are granted a limited, non-exclusive, revocable right to use the Service during your subscription period. You may not copy, reproduce, or create derivative works from Soostori without written permission.

To the maximum extent permitted by Kenyan law, Soostori shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, data, business, or goodwill, arising out of or related to your use of the Service.

Soostori's total liability for any claim arising from the Service shall not exceed the total subscription fees paid by you in the 12 months preceding the claim.

You agree to indemnify and hold harmless Soostori, its directors, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your violation of these Terms, your misuse of the Service, or your violation of any third-party rights or Kenyan law.

These Terms are governed by and construed in accordance with the laws of Kenya. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Kenya.
